For the purpose of this assignment assume you are a member of the Rio Grande Valley chapter of the Associated General Contractors of America (“RGVAGC”) not employed by or related to any of the companies directly involved in the disputes mentioned in the article. In light of the lawsuits filed by PSJA ISD, the RGVAGC is planning to host an open forum to discuss the ethics of the Right to Repair legislation and the situation with PSJA ISD to determine whether or not it wants to formally get involved in any way. Based on your respected COSC degree from TAMU, you have been asked to review the Right to Repair legislation, and prepare a memo to the membership addressing the following questions:
Is the Right to Repair legislation itself ethical? And is it something the AGC should support generally?
Is it generally ethical for government entities (like PSJA ISD) to file lawsuits using contingent fee agreements with attorneys?
Even assuming the Right to Repair legislation does NOT apply to PJSA ISD’s claims, is it ethical for PJSA ISD to file construction defect litigation without communicating with and making warranty claims to the contractors?
If the Right to Repair legislation does apply to PJSA ISD’s claims, is it ethical for PJSA to file these lawsuits based on the facts presented in the articles?
Does the American Institute of Constructors Code of Ethics help you analyze the ethics of these issues?
Devote a separate section of your memo to considering the bias of the articles you read about this situation. This section should consider the publisher/author of the article and who/what it represents and how that might all impact how it wrote about these issues? Specifically see if you can find words/phrases or sentences in each article that evidence bias.
